| The owner of my art gallery asked me to create an illustration for the bookmark she is handing out to her customers. She already has a business logo which will also appear on the bookmark. The illustration is in watercolor and ink, 2"x4" large. She likes the painting so much, she has offered to purchase the copyright from me. She is new in her business and is leaving the price to me. I have no experience with copyright fees. I realize that the fee may depend on the stipulations of the agreement, but I have no interest in "making a killing" now or in the future. Can someone give me a range or ballpark figure to suggest to her? Thank you for your advice. Claudiam |

| Let me start out by saying, I haven't been in your position yet, but every once in a while I'll read articles about copyright. You can also charge her a fee for usage rights, meaning she can use the image for a specific purpose (promotional materials for her gallery) but you would retain the copyright. You'd have to create a contract the specifies exactly how she uses the image and that if she wants to use it for something else, she would have to have your permission and/or renegotiate a new price. Plus if you want to be able use the image for other items, you need to put that in the contract also. This way you can still control the image's use, and possibly make other money from it in the future. The price for permission to use the image is so hard to tell you, if it was me, I would refer to how much I would sell the original for and add on to that the value I thought that she would get out of it. Try searching the internet and see what Illustrators charge for the use of their illustrations. |

| After taking the advice, I search the Internet, did a little bit of reading, and consulted professional sites which sell copyrighted-use of photographs. I determined that $91.00 per image was reasonable. The purchaser felt that $100 per image was more fair. So we are both happy with my final charge of $100. Thank you for your suggest. CM |
